Seller – SC GIVIAN DELICEPAN S.R.L.
Buyer – Any individual over 18 years old, legal entity, or any other entity making a booking on the site and completing payment.
Client – Any individual over 18 years old or legal entity who accesses the website content via any communication means provided by Panoramic Colibita (electronically, by phone, etc.).
User – Any individual over 18 years old or legal entity accessing the website who, by completing the booking process, agrees to the terms and conditions of the site.
My Cart – Section of the site where the Buyer/User can add the accommodation services they wish to purchase online.
Site – The web page hosted online at www.panoramic-colibita.ro and its subdomains.
Services – Any accommodation or tourism services listed on the site, to be provided by the Seller to the Buyer upon completion of the transaction.
Campaign – A commercial action that features a limited number of accommodation units or services, available for a pre-defined time and quantity set by the Seller.
Content – Refers to:
Review – A written evaluation by a beneficiary of a service based on personal experience, commenting on whether the service meets the specifications provided by the Seller.
Rating – A method of expressing the degree of satisfaction of a Client/Buyer regarding a service, represented by a star rating from one to five stars. This satisfaction level is always associated with the written review.
Comment – An appreciation or observation on a review or another comment.
Document – These Terms and Conditions.
Commercial Communications – Any message sent via email/SMS/phone containing general or thematic information, details about similar or complementary services to those purchased, offers, promotions, or updates about services available on the site, as well as news or surveys.
Transaction – The payment or refund of an amount resulting from the sale of an accommodation service by Panoramic Colibita to the Buyer, processed via the card services provider approved by the Seller.
Specifications – All descriptions or details of services provided on the site.
Payment with euplatesc.ro – The payment service offered by the integrated provider on the site, enabling Clients/Buyers to make online card payments.
Token – A unique encrypted number associated with the Buyer's payment card after completing an online payment via euplatesc.ro, which can be used for authorizing future transactions through the service.
2.1. By booking a service on the site, the Buyer agrees to the form of communication (phone or email) used by the Seller to conduct its business operations.
2.2. The notification received by the Buyer after completing an online transaction serves as acceptance of the service. This notification is sent electronically (via email) or by phone.
2.3. For justified reasons, the Seller reserves the right to modify the quantity of services available on the site. If this occurs, the Seller will notify the Buyer via the provided email or phone number and refund the amount paid.
2.4. The document and information provided by the Seller on the site regarding the services and availability will form the basis of the purchase.
3.1. Access to make an online transaction is granted to any User.
3.2. Communication with the Seller can be conducted via direct interaction, online support (Live Chat) if available, or through the contact details listed in the "Contact" section of the Site. The Seller has the freedom to manage received information without needing to justify its actions.
3.3. In case of unusually high internet traffic from a specific network, Panoramic Colibița reserves the right to request Users/Buyers to manually enter CAPTCHA codes to protect the information on the Site.
3.4. SC GIVIAN DELICEPAN S.R.L. may publish on the Site information about accommodation services and/or promotions offered for a specific period and within the available stock.
3.5. All prices for accommodation services presented on the Site are expressed in RON (Romanian Leu) and include VAT, except for local or legal taxes, which may be paid separately according to applicable laws.
3.6. According to legal provisions, the price of tourism services displayed on the Site includes VAT. For details regarding the exact amount added to the accommodation service price, the User/Buyer can contact the Panoramic Colibița reception via rezervari@panoramic-colibita.ro or the phone numbers listed on the Site.
3.7. For online payments, the Seller is not responsible for any additional costs incurred by the Buyer, such as currency conversion fees applied by the issuing bank if the card's currency differs from RON. The Buyer assumes full responsibility for these costs.
3.8. All descriptions of accommodation services available on the Site (images, videos, multimedia presentations, etc.) are for presentation purposes and do not constitute a contractual obligation by the Seller.
3.9. Fourteen (14) days after purchasing an accommodation service, the Buyer may be invited to leave a review about the purchased service. The request will be sent to the email address provided by the Buyer. This contributes to informing other potential Clients/Buyers and helps enhance the range and detail of services offered.
4.1. The Seller may not assign or subcontract to a third party any service related to fulfilling a booking without notifying the Buyer and obtaining their consent. The Seller remains responsible for all contractual obligations toward the Buyer.
5.1. The content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, static images, text, and/or multimedia content presented on the Site, is the exclusive property of SC GIVIAN DELICEPAN S.R.L., which reserves all rights obtained directly or indirectly.
5.2. The Client/Buyer is not permitted to copy, distribute, publish, modify, or otherwise alter the content, use it in any context other than its original purpose as intended by SC GIVIAN DELICEPAN S.R.L., remove copyright marks, or participate in transferring or distributing materials derived from reproducing or displaying the content without prior written consent from SC GIVIAN DELICEPAN S.R.L.
5.3. No content communicated to the Client/User/Buyer through any means (electronic, phone, etc.) or obtained by accessing the Site constitutes a contractual obligation for SC GIVIAN DELICEPAN S.R.L.
6.1. Clients/Buyers may make bookings on the Site based on the availability provided by SC GIVIAN DELICEPAN S.R.L. by selecting the desired accommodation services and completing the booking by making a payment through the explicitly indicated methods.
6.2. By completing a booking, the Buyer confirms that all data provided for the purchasing process is accurate, complete, and true at the time of the booking.
6.3. By completing the booking, the Buyer agrees that the Seller may contact them by any means chosen by the Seller whenever necessary.
6.4. The Seller may cancel a booking after notifying the Buyer without further obligations from either party or liability for damages in the following cases:
6.4.1. The issuing bank of the Buyer’s card rejects the transaction for online payments.
6.4.2. The card processor invalidates the transaction.
6.4.3. The information provided by the Client/Buyer on the Site is incomplete or incorrect.
6.5. If the Buyer decides to cancel a booking after completing a transaction, they must contact Panoramic Colibița reception via the contact details provided in the “Contact” section of the Site.
6.6. If the booking is paid for, the Seller will refund the full or partial amount within a maximum of 15 days from the date of the Buyer’s notification about the cancellation. The refund will be made as follows:
6.6.1. For bookings paid by card -> Refund to the original payment account or by issuing a voucher.
6.6.2. For bookings paid by bank transfer -> Refund by bank transfer or by issuing a voucher.
7.1. Exceptions to the right of withdrawal from bookings include:
7.1.1. Bookings canceled within a time frame shorter than specified on the Site, provided the Buyer confirmed awareness of the conditions stated by SC GIVIAN DELICEPAN S.R.L. before making the booking.
7.1.2. Services whose availability is subject to legal regulations or authorities’ requirements beyond the Seller’s control.
8.1. SC GIVIAN DELICEPAN S.R.L. will maintain the confidentiality of any information you provide. Disclosure of such information or personal data will only occur under the terms outlined in this document.
8.2. The Buyer/Client may not make public statements, promotions, press releases, or disclose reservation details to third parties without prior written consent from SC GIVIAN DELICEPAN S.R.L.
9.1. The Buyer/Client can modify their consent regarding commercial communications containing general and thematic information, offers, or promotions as follows:
9.1.1. By adjusting the settings in their account.
9.1.3. By accessing the unsubscribe link in the commercial communications received from SC GIVIAN DELICEPAN S.R.L.

10.1. The prices of the Services displayed on the website www.panoramic-colibita.ro include VAT as per the applicable legislation.
10.2. The price, payment method, and payment deadline are specified in each Booking. The Seller will issue an invoice to the Buyer for the purchased Services, and the Buyer is obligated to provide all necessary information for issuing the invoice correctly, in accordance with applicable legislation.
10.3. The Seller will send the Buyer the invoice related to the Booking, which includes accommodation services sold by Panoramic Colibita, in electronic format to the email address provided by the Buyer or physically at the reception of the Panoramic Colibita hotel.
10.4. By making the Booking and paying for the services, the Buyer agrees to receive invoices in electronic format at the email address provided when making the online Booking.
10.5. If this information is unavailable for more than 48 hours, please report this issue to the email address: rezervari@panoramic-colibita.ro.
10.6. Payment via euplatesc.ro is a fast online card payment method that involves making the payment with a single click using the Token associated with the card, without needing to re-enter the card details for each transaction.
10.7. The euplatesc.ro payment option can be activated by the User or Buyer:

The User's/Buyer’s card details will not be accessible to SC GIVIAN DELICEPAN S.R.L. nor will they be stored by SC GIVIAN DELICEPAN S.R.L. or by the payment processor integrated into the Site, but only by the transaction authorization institution or another entity authorized to provide card data storage services, whose identity the User/Buyer will be informed of prior to entering the card details.
11.1. The terms of delivery for the Services sold by SC GIVIAN DELICEPAN S.R.L. are available on the website at the time of Booking.
12.1. The Seller shall not be held liable for any damages of any kind suffered by the Buyer or any third party as a result of the Seller fulfilling any of its obligations under the Booking, or for damages resulting from the use of the Services.
12.2. The Seller reserves the right to periodically update and modify the Terms and Conditions section of the Site to reflect any changes in the operation and conditions of the Site or any changes in legal requirements. The document becomes binding for Clients/Users from the moment it is displayed on the Site.
In the event of any changes, we will display the updated version of the Document on the Site, so please check this Document periodically.
13.1. Writing Reviews, Comments, Questions, and Answers can be done by Users/Buyers via email, in the messaging section of the Panoramic-Colibita Facebook page, or in the “Reviews” section of the location on Google. The information entered can be either positive or negative and must refer to the characteristics and usage of a service.
13.2. When submitting any Review/Comment/Question/Answer on social networks or by email, Users/Clients/Buyers grant the Seller a non-exclusive, irrevocable, territorially unlimited license and the right to use, reproduce, modify, adapt, publish, translate, distribute, and display this content.
13.3. Each User/Buyer, upon submitting a Review/Comment/Question/Answer in the mentioned sections, agrees to comply with the following rules:
Only refer to the characteristics and/or usage of a specific service, avoiding information related to aspects that may change (price or promotional offers) or information about the Booking process;
Use appropriate, non-offensive language, avoiding terms that may offend or harm any other User/Client/Buyer;
Ensure the information entered is realistic, accurate, non-deceptive, and compliant with applicable laws, including respecting the rights of other parties, copyright, trademarks, or other intellectual property or privacy rights;
Not provide or request, in any manner or to any extent, personal data (contact details, residential address information, phone numbers, email addresses, names, etc.) or any other information that may disclose such personal data;
Not include information and/or details about URLs (links) to other commercial websites conducting similar business activities to the Seller.
13.4. In addition to a realistic evaluation, when submitting a Review, the Buyer may also add a relevant Rating for the associated service, depending on the options available on each platform. Reviews, along with their corresponding Ratings, will influence the overall Rating of the Panoramic Colibita Hotel, a figure displayed in parentheses next to their title. Thus, a Review with a high Rating increases the overall Rating, while a Review with a low Rating decreases it. Users/Clients submitting Reviews with attached photo or video files must comply with the following rules:
Uploaded files must contain images and/or videos referring to the service for which the Review is written, ensuring that the uploaded files comply with copyright laws;
Uploaded files must not contain violence, adult content, obscene language, or other content offensive to a person or group based on race or ethnicity, religion, disability, gender, age, veteran status, sexual orientation, or political views;
Uploaded files must not contain information about other persons.
13.5. If a Review/Comment/Question/Answer is flagged by a User/Buyer as having inappropriate content, from a strictly subjective perspective, this content will be carefully examined by Panoramic Colibita to determine whether it violates the Site’s Terms and Conditions.
13.6. For complaints or grievances related to the purchased Service, Buyers can use the email address provided in the Contact section. The maximum response time for complaints is 30 calendar days from receipt.

16.1. Neither party shall be held liable for failure to fulfill its contractual obligations if such failure is due to a force majeure event. Force majeure is an unpredictable event beyond the parties’ control and which cannot be avoided or controlled.
16.2. If, within 15 (fifteen) days from the occurrence of such an event, it does not cease, each party has the right to notify the other party of the automatic termination of the contractual relationship without any of them being able to claim damages from the other.
